Terms and Conditions

Effective date: 12 September 2026

Website Terms and Conditions

These Terms govern use of this Website and its online enquiry process. They do not replace Nazcon's project-specific construction agreement, quotation, work order, sale agreement, allotment letter, warranty, refund terms or statutory disclosures. Those documents must be separately prepared and approved for each transaction.

1. Eligibility and lawful use

You may use the Website only if you are legally capable of entering into a contract under applicable Indian law. If you use the Website on behalf of an organisation, you represent that you are authorised to bind that organisation.

You must use the Website only for lawful purposes and in accordance with these Terms.

2. Purpose and scope of the Website

The Website provides general information about Nazcon, its construction services, capabilities, completed and ongoing projects, service locations, teams, quality processes, articles and contact options. Services described may include residential, commercial and hospitality construction, eco-friendly huts, pre-fabricated warehouses, renovation and remodelling, and related consultation.

Availability, scope, timelines and deliverables depend on the location, site conditions, approvals, technical feasibility, material availability and a separate written agreement.

3. No offer, booking or construction contract

Website content, enquiry responses, automated messages, brochures and preliminary discussions are invitations to enquire and are not a binding offer, booking, allotment, work order or construction contract unless expressly confirmed in a written agreement signed by authorised representatives of both parties.

Submitting an enquiry or requesting a consultation does not oblige you to purchase a service and does not oblige Nazcon to accept a project. Any binding engagement will be governed by the signed quotation, scope of work, specifications, drawings, bill of quantities, payment schedule and other project documents. If those documents conflict with these Terms, the signed project documents will control for that transaction.

4. Website information and project representations

We aim to keep the Website accurate and current; however, construction details may change because of design development, engineering requirements, site conditions, statutory approvals, supply constraints or client-approved variations.

Images, renders, floor plans, diagrams, maps, material samples, dimensions, specifications, timelines and completion dates shown on the Website are illustrative or indicative unless a signed project document expressly states otherwise. Colours, finishes and appearance may vary across devices and actual materials.

You should independently verify all material information and obtain professional advice before making a financial, construction or property decision.

5. Quotations, prices, taxes and variations

Any price, estimate, rate or cost indication displayed or discussed through the Website is preliminary unless set out in a valid written quotation. A quotation may be time-limited and may change following site inspection, design finalisation, quantity measurement, material selection, logistics, taxes, statutory fees and market conditions.

Unless a signed document states otherwise, prices do not include government fees, approval charges, utility deposits, third-party professional fees, taxes or client-requested variations. Additional or changed work must be documented and may affect price and time.

6. Payments, refunds and official channels

The Website does not presently process online payments. Do not send money merely because of a Website message or an unverified communication. Payments must be made only through payment instructions stated in an official invoice, receipt, work order or signed agreement issued by Nazcon through an authorised channel.

Nazcon is not responsible for payments made to personal accounts, unauthorised representatives or fraudulent payment details where the Company did not authorise or reasonably cause the transaction. If you suspect fraud, contact us immediately using the details in Section 23.

Cancellation, refund, milestone billing and retention terms are governed by the applicable signed project documents and mandatory consumer law. Nothing in these Terms removes a statutory refund or remedy that cannot lawfully be excluded.

7. Enquiries and information you provide

When you submit an enquiry, you must provide information that is accurate, current and relevant. You must not impersonate another person, submit another person's contact details without authority, or provide unlawful, misleading or infringing material.

You authorise us to use the information you voluntarily provide to respond to your enquiry, arrange a consultation or site visit, prepare a preliminary proposal, and maintain relevant business records, subject to our Privacy Policy and applicable law.

8. Calls, messages, WhatsApp and marketing preferences

If you expressly request a callback, message or consultation, Nazcon may contact you by telephone, SMS, email or WhatsApp for that purpose. Transactional or service-related communications may be sent where reasonably necessary to address your enquiry or an existing engagement.

Promotional communications will be sent only where there is a valid lawful basis and, where required, your consent. You may withdraw marketing consent at any time by replying "STOP", using an unsubscribe method, or contacting us. Withdrawal does not affect communications necessary for an active contract or request. We will honour applicable telecom and customer-preference requirements.

9. Privacy and personal data

Our handling of personal data is governed by the Privacy Policy displayed on the Website and applicable Indian law, including the Digital Personal Data Protection Act, 2023 and rules brought into force from time to time. The Privacy Policy should be read together with these Terms.

Do not submit Aadhaar numbers, banking credentials, health information or other sensitive or unnecessary information through general Website forms. For privacy questions, correction or erasure requests, consent withdrawal or grievances, contact info@nazconconstruction.com. Requests are subject to identity verification and applicable legal retention requirements.

10. Intellectual property

The Website and its content - including text, photographs, graphics, renders, videos, logos, layouts, icons, project descriptions, code and design elements - are owned by or licensed to Nazcon and are protected by applicable intellectual-property laws.

You may view and download Website content only for personal, non-commercial evaluation of Nazcon's services. You must not copy, reproduce, modify, publish, sell, scrape, frame, distribute, reverse engineer, create derivative works from, or commercially exploit any Website content without prior written permission, except where permitted by law.

Names, logos and marks belonging to third parties remain the property of their respective owners. Their appearance does not imply endorsement unless expressly stated.

11. User-submitted content

If you send drawings, photographs, plans, briefs or other materials, you confirm that you have the right to share them and that our receipt and use for your requested purpose will not violate another person's rights or law.

You retain ownership of your materials. You grant Nazcon a limited, non-exclusive permission to review, reproduce internally and share them with relevant staff, consultants or service providers only as reasonably required to respond to your request or perform an agreed service, subject to confidentiality and data-protection obligations.

12. Prohibited conduct

  • Attempting to gain unauthorised access to the Website, server, accounts, forms, data or connected systems.
  • Introducing malware, malicious code, automated attacks or an unreasonable technical load.
  • Scraping, harvesting or using contact or project information for spam, profiling or unlawful marketing.
  • Misrepresenting affiliation with Nazcon or using Website content to deceive another person.
  • Uploading unlawful, defamatory, obscene, infringing or harmful material.

We may restrict or block access where reasonably necessary to protect the Website, users, Nazcon or third parties.

13. Third-party services and external links

The Website may link to or embed third-party platforms such as maps, social media, messaging, analytics, video or hosting services. Third parties operate under their own terms and privacy practices. Nazcon does not control and is not responsible for third-party availability, security or content, except to the extent liability cannot lawfully be excluded.

14. Website availability and security

We may modify, suspend or discontinue any Website feature for maintenance, security, operational or legal reasons. We do not guarantee uninterrupted, error-free or malware-free access. You are responsible for maintaining suitable device security, backups and network protection.

15. Disclaimer of Website warranties

To the maximum extent permitted by law, the Website is provided on an "as available" basis for general information. We do not make warranties about continuous availability, completeness, suitability for a particular purpose or that Website content alone is sufficient for a construction, investment, engineering, legal, tax or financial decision.

This disclaimer applies only to the Website and does not reduce warranties, quality commitments or remedies expressly provided in a signed project agreement or mandatory law.

16. Limitation of liability

To the maximum extent permitted by law, Nazcon will not be liable for indirect, incidental, special or consequential loss arising solely from use of, inability to use, or reliance on the Website. Any liability connected with an actual construction or property transaction will be determined under the relevant signed documents and applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of confidentiality or data-protection duties, or any other liability or consumer remedy that cannot lawfully be excluded or limited.

17. Indemnity for misuse

You agree to indemnify Nazcon against direct losses, claims and reasonable costs resulting from your unlawful misuse of the Website, infringement of third-party rights, malicious interference with Website systems, or material breach of these Terms. This clause does not apply to loss caused by Nazcon and does not limit any non-waivable consumer right.

18. Statutory approvals and regulatory disclosures

Construction and property matters may require approvals, permissions, registrations and disclosures from competent authorities. The responsibility for obtaining each approval will be allocated in the signed project documents. Website content must not be treated as proof that a particular approval has been obtained.

Where the Real Estate (Regulation and Development) Act, 2016, related rules or another project-specific law applies, the relevant registration, sanctioned plans, disclosures and executed sale or allotment documents will prevail over general Website content.

19. Force majeure and external events

Website availability and preliminary service timelines may be affected by events beyond reasonable control, including natural disasters, severe weather, shipping or supply disruption, labour disruption, government restrictions, utility failure, cyber incidents and telecommunications failure. Project-specific force-majeure rights and obligations will be governed by the relevant signed agreement and applicable law.

20. Changes to these Terms

We may update these Terms to reflect changes in law, services, technology or business practices. The revised version will be posted with a new "Last updated" date. Material changes will apply prospectively unless law requires otherwise. Continued use after publication of revised Terms constitutes acceptance of those Terms.

21. Suspension and termination

We may suspend or terminate access for unlawful use, security threats or material breach. Provisions that by their nature should survive - including intellectual property, disclaimers, liability limits, dispute provisions and accrued rights - will continue after termination.

22. Governing law and disputes

These Terms are governed by the laws of India. Before commencing ordinary court proceedings, the parties should attempt in good faith to resolve a Website-related dispute by written notice and discussion for 30 days.

Subject to mandatory law and the jurisdiction of consumer commissions or other statutory authorities, courts of competent jurisdiction in Port Blair, Andaman & Nicobar Islands will have jurisdiction. Nothing in these Terms prevents a consumer from using a remedy or forum available under applicable consumer law.

23. Customer support, privacy and grievance contact

Questions, complaints, privacy requests or notices concerning the Website may be sent to:

  • Nazcon Construction Division
  • Business contact address: Junglighat, Port Blair, Andaman & Nicobar Islands, India
  • Email: info@nazconconstruction.com
  • Telephone: +91 99332 69999

Please include your name, contact details, a clear description of the issue and any relevant reference number. We aim to acknowledge consumer grievances within 48 hours and to resolve them within 30 days, subject to complexity and applicable law.

24. General provisions

If any provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not assign rights under these Terms without our prior written consent; Nazcon may assign them as part of a lawful restructuring, transfer or succession, subject to applicable law.

These Terms, together with the Privacy Policy and any notices expressly incorporated into them, form the agreement governing use of the Website. They do not replace any separately executed transaction document.
